Monthly Payment Plans:
FOR VALUE RECEIVED, the Borrower promises to pay The School of Natural Cookery, llc the total amount of the course purchased. Monthly payments shall continue until the entire indebtedness is fully paid; provided, however, if not sooner paid, the entire amount outstanding, and late charges and default interest thereon, if any, shall be due and payable on the last payment date. Borrower shall pay a late charge of five percent (5.0%) of any payment not received within ten (10) calendar days after the payment is due.
Payments received shall be applied first to the payment of attorney’s fees and costs, if any; second to the payment of penalty interest, if any, at the increased rate specified below; third, to the payment of late charges, if any; fourth to the payment of accrued interest first specified above, and the balance applied in reduction of the principal amount thereof. If any payment required by this Agreement is not paid when due, the entire amount outstanding shall at once become due and payable at the option of The School of Natural Cookery (Acceleration). To exercise this option, the School of Natural Cookery shall give the Borrower a Notice of Acceleration specifying the amount of the nonpayment. The Borrower shall have ten (10) business days after the Notice of Acceleration has been given to reinstate the terms of this Agreement, as they were immediately before such notice, by paying the amount of nonpayment specified in the Notice of Acceleration.
Unless so reinstated, the indebtedness shall bear interest at the penalty rate of eighteen percent (18%) per annum from the date Notice of Acceleration is given. The School of Natural Cookery shall be entitled to collect all reasonable costs of collection, including attorney’s fees, regardless of whether a lawsuit is commenced. Said fees and costs shall bear interest from the date of disbursement at the same rates specified herein for the balance of this Agreement. The School of Natural Cookery’s failure to exercise Acceleration shall not constitute a waiver of the right to Acceleration in the event of any subsequent default.
Borrower may prepay the amount outstanding under this agreement, in whole or in part, at any time without penalty. Any partial prepayment shall be applied against the amount outstanding and shall not postpone the due date of any subsequent payments or change the amount of such payments. Presentment, notice of dishonor, and protest are hereby waived by Borrower and all other makers, sureties, guarantors and endorsers hereof. This Agreement shall be the joint and several obligation of Borrower and all other makers, sureties, guarantors and endorsers, and their successors and assigns. Any notice to Borrower provided for in this Agreement shall be in writing and shall be given and be effective upon; (a) personal delivery to Borrower or (b) three (3) business days after mailing such notice, addressed to Borrower at the Borrower’s address stated at time of purchase, or to such other address the Borrower may designate by notice to the School of Natural Cookery. Any notice to the School of Natural Cookery shall be in writing and shall be given and be effective upon: (a) personal delivery to School of Natural Cookery or (b) three (3) business days after mailing such notice to The School of Natural Cookery at P.O. Box 19466 Boulder, CO 80308, or to such other address as School of Natural Cookery may designate to Borrower in a notice or other writing.
The obligations of Borrower are independent of whether Borrower completes the course which caused the underlying debt.
Refund Policy: No refunds are made 36 hours after registration , unless the session is canceled. If you need to cancel after the 36 – hour time period has lapsed, credit will be applied towards any course for up to one year.
Proprietary Information: I recognize the courses at The School of Natural Cookery are based on a proprietary language and system of teaching cooking. I agree to use this information for personal growth. If I decide to share this unique system with others, I will first get certification through the Natural Cook Teachers Training program.
